Prosecution
Probably the most visible duty of the County Attorney's office is prosecuting cases in both Campbell District and Family Courts. The prosecution in Campbell District Court begins with the arraignment (first court appearance for a criminal case) of all charges filed in Campbell County, including those for which individuals are arrested. My Assistant County Attorney's and I prosecute misdemeanor cases through their conclusion, including either jury or bench trials before one of the district court judges. We prosecute felony cases through the arraignment stage which is where a Defendant is asked whether he is guilty or not guilty. Given the inherent severity of a felony, usually an automatic plea of not guilty is entered, and the case is set for a preliminary hearing. At this stage the Commonwealth Attorney's office takes over the prosecution of felony cases and handles them through their conclusion. As part of the prosecution of criminal cases in Campbell County, our office takes private criminal complaints, whereby citizens can charge individuals criminally if these individuals have performed a criminal act for which the individuals a victim. Our office takes these complaints Monday through Friday from 9:00 a.m. to 12:00 p.m.
