Campbell County Bad Check Program |
1. If you are unable to collect a bad check after reasonable notice, you may bring the check to the Campbell County Attorney's Office at 331 York Street, Newport, Kentucky between the hours of 9:00 A.M. and Noon, Monday through Friday, for collection purposes. You should have a valid address and be able to identify the maker of the check. We cannot issue criminal charges with a P.O. Box, as the Sheriff cannot serve the Defendant without a complete address.
2. We will then send a letter notifying the party that they have ten (10) days within which to make the check good. The writer of the check will need to make payment of the check at your place of business, together with a $25.00 prosecutor's fee and a $25.00 service fee to help defray your bank charges. A copy of the check will then be placed in a calendar file marked for two weeks.
If the individual makes the check good within that time frame, you will need to call our office and notify us of payment and send us the $25.00 prosecutor's fee. If not paid, you need to notify us on the two week date that payment was not received and we will then file a criminal complaint for THEFT BY DECEPTION which you will need to sign. We will not automatically issue criminal charges. We need to hear from you.
3. Once the criminal complaint is signed, the defendant will receive a summons to appear in Court for arraignment in approximantely three (3) weeks. You will not need to be present for the arraignment.
4. If the individual pleads not guilty, the case will be set for a hearing within approximately two (2) weeks and you will be notified to be in Court on that date.
5. IT IS IMPERATIVE that you do not give the original check to the maker of the check if the individual comes into pay after the complaint has already been issued because it may be necessary to produce that check in Court. If the criminal complaint has not been issued when the writer comes in to make it good, it is all right to return the check to the writer.
6. You should bring the bad checks to our office as soon as possible after your efforts to collect. The sooner we pursue collection, the better the results. Also, we do not want a lot of checks from a long period of time brought in at one time.
7. At whatever point in time you receive payment for the check, you should tell the writer of the check that the $25.00 prosecutor's fee and your $25.00 service fee must also be paid or the case will still go to Court. You must always pay the $25.00 prosecutor's fee to this office after you receive it, either by mailing it immediately to us or bringing it to our office if you will be in our office for additional checks within two (2) weeks. If you do not pay that fee to us, we will no longer handle your bad checks. The fees due our office can be paid in cash or by check made payable to the Campbell County Attorney.
